SEATTLE, WA (MyBellinghamNow.com) – The person injured in Tuesday’s shooting in Blaine involving U.S. Customs and Border Protection has been identified.

The U.S. Attorney’s Office for the Western District of Washington said that 39-year-old Nathaniel Muniz-Spry of Everson made his first appearance in federal court Wednesday afternoon.

Muniz-Spry was hospitalized at PeaceHealth St Joseph’s Medical Center after border agents fired shots on the corner of Fourth and A Streets in Blaine after 5 a.m. Tuesday, June 16. He was shot in the leg by agents and released from the hospital later that day.

An unknown number of U.S. Customs and Border Protection agents were involved in the incident, but FBI Seattle said that none of them were injured.

New details released from U.S. Attorney Charles Neil Floyd’s Office

The U.S. Attorney’s Office said agents first spotted Muniz-Spry on security footage walking in a location frequently used for illegal border crossings and smuggling activity.

After agents contacted him and verified his identity, they received an alert to “approach with caution” Muniz-Spry stemming from previous encounters with law enforcement. Agents also felt what they said was a gun in his waistband upon a search of his person. Muniz-Spry broke away from the agent during the search as the agent took the gun.

Muniz-Spry has nine separation criminal convictions related to theft, firearm possession, burglary, bail jumping and violating a no-contact order going all the way back to 2009. All convictions were either in Whatcom or Skagit counties.

Muniz-Spry faces one federal charge of being a felon in possession of a firearm.

The FBI is leading the investigation and will release further details once they’re available.
